Terms of Service

1. Acceptance of these Terms

These Terms of Service ("Terms") form a binding agreement between you and the operator of the Kingdom of Arya project ("Arya," "the Kingdom," "we," "us"), reachable at court@aryakingdom.com, governing your use of the website aryakingdom.com (the "Site") and any purchase of digital or physical items offered through it. By accessing the Site, submitting a citizenship petition, or making a purchase, you accept these Terms, our Privacy Policy, and our Refund Policy. If you do not agree, do not use the Site.

2. Nature of the Project — Entertainment Only

The Kingdom of Arya is an international digital, cultural, and creative micronation project operated for novelty, collectible, artistic, and entertainment purposes. You expressly acknowledge and agree that:

• Arya is not a sovereign state, government, or governmental body, and is not recognized by the United Nations, the Government of Canada, or any other nation or international organization;
• no item issued by Arya — including citizenship cards, digital passports, titles, peerages (Duke, Duchess, Lord, Lady, Knight, Dame, or any other style), decrees, letters, land grants, or certificates — confers citizenship, nationality, residency, immigration status, visa rights, diplomatic status or immunity, tax status or exemption, professional qualification, security clearance, or any legal right, privilege, or authority of any kind in any jurisdiction;
• "virtual land" and "digital districts" are purely symbolic designations with no connection to real property anywhere in the world and convey no property rights;
• all items are personalized novelty and collectible goods within a creative community.

3. Eligibility

You must be at least eighteen (18) years old, or the age of majority in your jurisdiction if higher, to make a purchase on the Site. Persons aged thirteen (13) to seventeen (17) may browse the Site and participate in free community activities only with the consent and supervision of a parent or legal guardian. The Site is not directed to children under thirteen (13). By purchasing, you represent that you meet these requirements and that your use of the Site is lawful in your jurisdiction.

4. Products, Titles & Digital Items

Items offered through the Royal Registry (citizenship, knighthoods, lordships, duchies), Royal Services (heraldic designs, letters of recommendation), and related digital goods are delivered electronically to the email address you provide, normally within forty-eight (48) hours of payment confirmation unless otherwise stated. Physical items, where offered (such as optional framed certificates), are shipped to the address you provide, with shipping timelines and any customs duties communicated at the time of order. Titles are honorific styles used within the Arya community; we do not guarantee that any third party, platform, or authority will recognize or use them. Community features (such as the Discord server or Advisory Council sessions) are provided as available and may change, and access to them requires compliance with these Terms and the platform's own terms.

4b. The Royal Land Registry — Virtual Land

The Site includes an interactive map of virtual "land lots" (the "Land Registry"). Purchasing a lot grants you a personal, non-exclusive, revocable, symbolic license to be recorded as its holder within our community, to customize its public land page (story, links, artwork) and to use holder features (the Royal Post pigeonhole, dispatches in the Town Square). A land grant is a novelty digital item: it is not real property, a security, an investment, a cryptocurrency, or an NFT, conveys no interest in any real-world land or in the Site's infrastructure, and has no resale market operated by us. Lots, postal codes, districts, prices and map features may be adjusted by the Crown for the integrity of the map, provided your recorded holding is preserved or an equivalent lot is offered. Claims that are not paid within a reasonable time may be released back to the market. We may remove or replace lot artwork or content that violates Section 8 and, for repeated or serious violations, revoke a holding under Section 10.

4c. Accounts

Some features (holding land, petitions, the Royal Post, the Town Square) require an account. You are responsible for the accuracy of your account information, for keeping your password confidential, and for activity under your account. You must be at least eighteen (18) to create an account or make purchases. We may suspend accounts that violate these Terms.

4d. Transfers & Gifts of Virtual Land

A land holder may voluntarily transfer or gift a lot to another registered account through the transfer feature on the lot's land page. A transfer conveys only the same personal, non-exclusive, revocable, symbolic license described in Section 4b — it is not a sale, assignment, or conveyance of property, and it creates no rights beyond those the transferor held. Transfers are final and irreversible once sealed: we cannot reverse a transfer at either party's request, and only a subsequent voluntary transfer by the new holder could return the lot. We are not a marketplace, broker, or escrow agent; we do not facilitate, process, or guarantee any payment or other consideration exchanged between citizens for a transfer, and any such arrangement is solely between the parties at their own risk. You must not use transfers for money laundering, fraud, evasion of these Terms, or any unlawful purpose. Each transfer is recorded in a permanent audit ledger (transferor, transferee, lot, note, and time) for the integrity of the Registry. The Crown may suspend the transfer feature realm-wide at any time, may decline to recognize a transfer obtained by fraud, coercion, or breach of these Terms, and may restore a lot's prior record where our error caused a mistransfer. Transfers do not affect the Refund Policy: a transferred lot is not refundable, and transferring a lot does not create any refund right for either party.

5. The Aryak (ARYAK) — No Monetary Value

The Aryak (ARYAK) is a closed-loop point and reward system used solely for engagement within the Arya community. ARYAK: (a) is not money, legal tender, electronic money, a cryptocurrency, a token, a security, or an investment of any kind; (b) has no cash value and cannot be redeemed, exchanged, sold, or transferred for money or anything of monetary value; (c) may not be traded outside the community; and (d) may be adjusted, expired, or discontinued by us at any time without compensation. Nothing on the Site constitutes financial, investment, or legal advice.

6. Orders, Pricing & Payment

All prices are stated in United States dollars unless otherwise indicated and may change at any time before an order is confirmed. Payment is collected through third-party payment processors; we do not receive or store your full card details. An order is accepted only when we confirm it by email. We may refuse or cancel any order at our discretion (for example, where fraud, error, or a breach of these Terms is suspected); if we cancel a paid order, we will refund it in full. You are responsible for providing an accurate email and, where relevant, shipping address; items delivered to the address you provided are deemed delivered. Refunds are governed by the Refund Policy.

Land purchases. Land lots are priced per pixel by district tariff and shown before checkout. Payment is collected through third-party processors (such as Stripe for cards and Coinbase Commerce for cryptocurrency) or, where offered, by direct cryptocurrency transfer verified by the Treasury. A lot is "claimed" while you complete payment and becomes yours when payment is confirmed; the digital deed and holder features are delivered immediately upon confirmation. Cryptocurrency payments are irreversible by nature — send only the exact asset and amount shown.

7. Prohibited Uses of Titles & Materials

Because our items are symbolic, using them to mislead others is strictly forbidden. You agree that you will not use any Arya item, title, document, or material to:

• misrepresent your legal identity, nationality, citizenship, or immigration status to any person, government, financial institution, employer, or other party;
• attempt to cross a border, obtain a visa, open a financial account, obtain credit, or pass any identity or background check;
• impersonate a government official, diplomat, or holder of a legally recognized noble or state title;
• commit or facilitate fraud, deception, money laundering, or any unlawful act;
• suggest an affiliation with, or endorsement by, any real government or authority.

Any such use is a material breach of these Terms, will result in immediate revocation of all items and honors without refund, and may be reported to relevant authorities.

8. Community Conduct

Participation in Arya community spaces requires adherence to the Code of Digital Chivalry: no harassment, hate speech, threats, doxxing, spam, sexual content involving minors, or unlawful content of any kind; respect for other members; and honesty in dealings. We may moderate, restrict, suspend, or remove any member or content at our discretion to protect the community.

Your content. Content you publish through the Site — land-page stories and links, lot artwork, dispatches, replies, and letters — must be lawful, must not infringe others' rights, and must not contain hate speech, harassment, sexually explicit material, malware, or spam. You retain ownership of your content and grant us a worldwide, non-exclusive license to host and display it as part of the Site. We may remove content that violates these Terms and may preserve or disclose content where required by law.

9. Intellectual Property

The Site and all its content — including the name "The Kingdom of Arya," the royal crest and arms, the national flag design, coin designs, logos, text, graphics, and page designs — are owned by the project operator or licensed to us, and are protected by copyright and other intellectual-property laws. Certificates and heraldic designs delivered to you are licensed for your personal, non-commercial display and enjoyment; commissioned personal crests may also be used for the personal or brand purposes described at the time of purchase. You may not reproduce Site materials to create competing or confusingly similar products, and you may not present any Arya material as an official government document. Nothing on the Site grants you any trademark or other proprietary rights in the Arya name or symbols.

10. Termination & Revocation of Honors

We may suspend or terminate your access to community features, and revoke titles and honors, if you materially breach these Terms, with immediate effect in serious cases (including any breach of Section 7). You may leave the community at any time by written notice to court@aryakingdom.com. Sections 2, 5, 7, 9, and 11 through 16 survive any termination.

11. Disclaimers & "As Is" Provision

The Site and all items and community features are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. We do not warrant that the Site will be uninterrupted, error-free, or secure. Some jurisdictions do not allow the exclusion of certain warranties; where consumer-protection law grants you non-waivable rights, those rights are unaffected.

12. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for loss of profits, data, goodwill, or reputation, arising from or related to the Site or any item, even if advised of the possibility. Our total aggregate liability for all claims arising out of these Terms or your use of the Site shall not exceed the greater of (a) the total amount you paid to us in the twelve (12) months preceding the claim, or (b) fifty US dollars (US$50). Nothing in these Terms excludes liability that cannot be excluded by law, including for fraud or for death or personal injury caused by negligence.

13. Indemnification

You agree to indemnify and hold harmless the project operator and its affiliates, officers, and agents from any claims, damages, losses, and reasonable legal costs arising out of your breach of these Terms, your misuse of any Arya item (including any use prohibited by Section 7), or your violation of any law or third-party right.

14. Governing Law & Disputes

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. Subject to any mandatory consumer-protection rights available in your place of residence, the courts of Alberta, Canada shall have exclusive jurisdiction over disputes arising from these Terms or the Site. Before commencing any proceeding, you agree to first contact us at court@aryakingdom.com and attempt in good faith to resolve the dispute informally for thirty (30) days.

15. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above reflects the current version. Material changes will be announced on the Site and, where practicable, by email to registered citizens. Continued use of the Site after changes take effect constitutes acceptance; changes do not apply retroactively to completed purchases.

16. General Provisions & Contact

These Terms, together with the Privacy Policy, Refund Policy, and the Legal Disclaimer displayed on the Site, constitute the entire agreement between you and us regarding the Site. If any provision is held unenforceable, the remainder remains in effect, and the unenforceable provision is replaced with a valid one that most closely reflects its intent. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a transfer of the project.
